A Bronx, N.Y., man, charged with identity theft, pleaded guilty and was sentenced to probation in Butler County Court Friday.

Edgar E. Arias-Mateo, 26, entered a guilty plea to charges of felony conspiracy to commit theft by deception and identity theft before Judge Timothy McCune.

He was then sentenced to 21 days to six months in the Butler County Prison, and immediately paroled with time served of 21 days.

Arias-Mateo was then ordered to undergo 12 months probation following his parole, which will be transferred to New York, pay a $200 fine and undergo any recommended counseling and treatment.

His attorney, Michael Muha, said his client is “very remorseful for his actions,” asking for the probationary sentence.

Arias-Mateo, who is originally from the Dominican Republic, through a Spanish-speaking interpreter apologized to the court, saying, “I am very sorry. I have never before committed a crime.”

He was initially charged with felony counts of conspiracy, identity theft, theft by deception and receiving stolen property, alongside Marleni R. Tavarez, 23, of New York City, after an incident at the AT&T store on Route 19 in Cranberry Township on Jan. 18.

Police said the two conspired to possess and use identification of another person to commit theft, buying four iPhone 7s from the store using the fraudulent information.

Arias-Mateo told police he was in the area to visit family, but could not say where they were, according to police reports. He was in his vehicle when questioned by officers, according to court documents.

Tavarez was in the store trying to place the phones on an account she did not have permission to use, police reports state.

Police say someone had replaced one of the account holders with Tavarez so she could add the new phones to the victim's existing account without having to pay for them herself.

The phones were valued at $850 each.

Arias-Mateo was also found with three cellphones in his possession, which contained the Social Security numbers of other individuals that he was not permitted to possess, according to information delivered in court.

Police said Tavarez reported that Arias-Mateo would give her $100 for every phone she got for him.

Arias-Mateo was arraigned and held in the Butler County Prison on $75,000 bail. That amount was later lowered to $25,000, which was posted.

Tavarez' charges were later withdrawn, according to previous reports.
