Homeless man sentenced
A homeless man who attacked another transient man with a box cutter-style knife over $5 in beer money was sentenced Thursday to serve up to 23 months in prison.
Scott H. Fosnaught, 54, pleaded guilty to aggravated assault and was sentenced by Butler County Judge Timothy McCune.
According to court records, the altercation occurred May 13, 2014, in a wooded area in Butler's Clay Hills area.
The victim, Mark Graham, then 51, told investigators he gave Fosnaught $5 to buy beer. Fosnaught didn't return for two days, and when he returned, he was empty-handed.
The two men argued, and Graham received a 10-inch long and one-inch deep cut across half of his lower stomach.
Fosnaught, who told investigators he acted in self-defense, initially was charged with attempted homicide. However, prosecutors agreed to drop that charge when Fosnaught pleaded guilty to a second-degree felony count of assault.
In addition to a prison sentence of 11½ to 23 months, Fosnaught was ordered to serve 18 months of probation. At the time of sentencing, he was given credit for the 339 days he already served awaiting resolution of this case.
Neither the defendant nor the victim gave statements in court.
