PUC fines West Penn Power $1.3 million

HARRISBURG — West Penn Power will pay a $1.3 million fine for failing to reduce its electricity consumption in accordance with state guidelines.

The state Public Utility Commission on Thursday approved the fine. West Penn must pay the penalty within 30 days and may not recover any portion of the payment from ratepayers or in rates, according to the PUC. The civil penalty will be paid to the state’s General Fund.

Act 129 of 2008 required each electric distribution company with at least 100,000 customers to submit an energy efficiency and conservation plan that would reduce usage by 1 percent by May 31, 2011, and by 3 percent by May 31, 2013. Peak usage also was to be reduced by 4.5 percent by May 31, 2013.

While West Penn Power exceeded its goal of reducing its use by 2013, it fell short of its 2011 reduction.

At that time, West Penn reported a reduction of about 90,000 MWh. It had a target of more than 209,000 MWh, which it eventually hit by November that year.
