Man pleads guilty to disorderly charge
A Butler man took a plea deal Monday in district court in an assault case.
James J. Gautreau, 48, of Butler, appeared in court for a preliminary hearing Monday afternoon alongside public defender Michael McFarland. Gautreau posted a $10,000 bond shortly after his arrest in January.
City police accused Gautreau of assaulting a woman in a domestic dispute the night he was arrested.
Gautreau had been charged with one felony count of strangulation as well as misdemeanor counts of simple assault and disorderly conduct.
He pleaded guilty to the one misdemeanor count of disorderly conduct.
McFarland said he had no comment on the deal, which resolved the case Monday at the district level.
District Judge William Fullerton imposed a $500 fine related to the disorderly conduct offense. Gautreau also has to pay $216 in court fees related to the case.
The third-degree misdemeanor to which Gautreau pleaded had a maximum of one year in jail and a fine of up to $2,500.
Assistant District Attorney Amanda Scarpo accepted the agreement on the prosecution's behalf.
Scarpo said both the victim and witness were unwilling to proceed to trial.
“Without evidence, we're unable to proceed,” she said.
