Most serious charges withdrawn against suspect

Man accused of shooting son

EVANS CITY — An Adams Township man charged with shooting his son in the ankle during a domestic fight had the most serious charges against him withdrawn.

Before the hearing for Frank C. Strutz Jr., 57, at District Judge Wayne Seibel’s office Monday, Assistant District Attorney Russ Karl withdrew two counts of aggravated assault and one count of discharging a firearm in an occupied structure.

Strutz did waive to trial lesser charges of simple assault and reckless endangerment.

Also, one condition of Strutz’s $10,000 bail — that he have no contact with his son — was removed.

Strutz posted the bail on Aug. 24, the same day he was arrested.

Strutz was arrested after he allegedly shot his 27-year-old son in the lower leg during a domestic dispute at the family’s home on Cashdollar Road. Both he and his son were arguing in the garage under the house when the shooting happened about 12:20 a.m.

Strutz was angry about how loud his son was playing his heavy metal music when the two of them fought, according to court documents.

Both men had been drinking beer all day, according to earlier comments by Adams Township Police Detective Michael Bailey.

Strutz has admitted to firing one or two “warning shots” from his 9 mm Glock handgun out the open garage door toward the woods before his son grabbed him by the arms, the court documents state. Another round was fired and hit Steve Strutz in his left ankle and foot area.

In the police complaint, the elder Strutz said he could have shot his son in the head, chest or stomach but did not do so because he is his son.

The gun jammed after the last shot. The two of them continued to fight and hit one another after the shooting.

Police found the pistol, which had a magazine clip with 11 rounds in it, and a round was jammed in the ejection port.

Officers said they found the Glock andtwo other handguns in the garage. They also found two shell casings and a bullet fragment.

Strutz has had to surrender all of his firearms to the police.

His formal arraignment will be Nov. 10.
