Court Sentencing
Butler County President Judge Thomas Doerr handed down the following sentences Wednesday.
Amy L. Allaman, 38, of Clarion County, was sentenced to 12 months of probation; ordered to pay a $50 fine; ordered to pay two civil penalties of $150, and serve Intermediate Punishment Program terms of 36 months with 90 days on house arrest and electronic monitoring, and perform a total of 200 hours of community service.
Allaman was sentenced Wednesday in four cases from 2017. In one case, she pleaded guilty to use or possession of drug paraphernalia; in a second she pleaded guilty to disorderly conduct; and in two other cases she pleaded guilty to filing false insurance claims.
The insurance fraud cases were prosecuted by the state Attorney General’s Office, while the drug and disorderly conduct charges were prosecuted by the County District Attorney’s Office.
Joseph T. Bailie, 41, of Butler, was sentenced to 60 months in the county’s Intermediate Punishment Program, with the first three months of the program at Butler County Prison and nine months of the program on house arrest with electronic monitoring; and ordered to pay a $2,500 fine.
According to court documents, Bailie pleaded guilty July 13 to DUI-second offense and DUI with a suspended license. Charges of DUI, possession of a small amount of marijuana, use or possession of drug paraphernalia and obscured plates were dismissed.
Micah J. Christy, 32, of Butler was sentenced to 3 months to 18 months in Butler County Prison and immediately paroled, followed by a total of 30 months of supervised release.
According to court documents, Christy pleaded guilty July 13 to possession of a controlled substance and endangering the welfare of children in two separate cases. Charges of possession with intent to deliver and use or possession of drug paraphernalia were dismissed.
Christy was charged by the Butler County Drug Task Force last year, after selling a police informant 10 stamp bags of heroin in August. One month later, when police served a search warrant at his West New Castle Street home, they found a 6-year-old girl within arm’s reach of uncapped syringes and empty stamp bags of suspected heroin.
Tyler A. Irvine, 34, of Butler, was sentenced to six months in the county’s Intermediate Punishment Program and ordered to pay a $1,000 fine.
According to court documents, Irvine pleaded guilty July 17 to DUI. Charges of speeding and DUI-controlled substance were dismissed; and a charge of careless driving had been previous withdrawn at the district court level.
Aissa Kachkouch, 26, of Pitcairn, Pa., was sentenced to 9 months to 18 months in Butler County Prison followed by 66 months of probation and immediately paroled.
According to court documents Kachkouch pleaded guilty July 10 to one felony count of theft by unlawful taking.
Amy L. Kline, 44, of Zelienople was sentenced in two separate cases to 6 months in the county Intermediate Punishment Program and ordered to pay a $300 fine; and 60 months of IPP, ordered to pay a $1,500 fine and complete 100 hours of community service.
According to court documents, Kline pleaded guilty June 19 in two separate DUI cases — one from May 2017 and another from December 2017.
In the first case, Kline pleaded guilty to DUI and improper display of license plate; a second count of DUI was dismissed.
In the second case, Kline pleaded guilty to DUI; a second count of DUI was dismissed and two other counts of DUI were withdrawn.
Christopher B. Myers, 35, of Butler was sentenced to 72 hours to 6 months in Butler County Prison for DUI, time-served to 6 months in jail for possession of drug paraphernalia, and ordered to pay a $200 fine for driving during suspension.
According to court documents, Myers pleaded guilty to the charges on July 10. Two other counts of DUI and citations for operating a vehicle without a valid inspection and driving the wrong way were dismissed.
Joseph R. Painter, 35, of Kittanning was sentenced to 3 months of probation and ordered to pay a $300 fine.
According to court documents, Painter pleaded guilty July 10 to one misdemeanor charge of conspiracy to commit loitering or prowling at night.
He was initially charged with numerous felony counts of burglary, robbery and conspiracy, after a failed attempt to steal proceeds of an illegal business that was being run out of a home on Petrolia Road.
One man charged in connection with that break-in — Patrick C. Bookwalter, 36, of Rimersburg — was sentenced in July to 5 to 10 years in state prison. A third man charged in the break-in, Michael L. Bure, 36, of Worthington, Armstrong County, awaits further court proceedings.
The homeowners — Savannah M. Blust, 24, and Macklin C. Haye, 24 — both ultimately pleaded guilty to drug-related charges stemming from the case and were sentenced to county jail and probation.
Candace M. Rikal, 42, of Prospect was sentenced to 6 months’ probation, ordered to pay $273 in restitution and a $50 fine.
According to court documents, Rikal pleaded guilty July 31 to one misdemeanor count of bad checks.
Rio Sayers, 19, of Sewickley was sentenced to a total of 30 months’ probation and ordered to complete 16 hours of community service.
According to court documents, Sayers pleaded guilty July 10 to two misdemeanor counts of possession of a controlled substance and one count of possession of drug paraphernalia.
Timothy A. Swank, 51, of Shelocta, Pa., was sentenced to 72 hours to 6 months in Butler County Prison, ordered to pay a $1,000 fine and complete 60 hours of community service, and 12 months of probation. He was given credit for 5 weeks of time served.
According to court documents Swank pleaded guilty July 13 to one misdemeanor count of DUI-controlled substance and one count of possession of drug paraphernalia.
Taneesha Z. Upshur, 22, of Philadelphia was sentenced to time served to 23½ months in Butler County Prison and ordered to pay a $250 fine; and 24 months’ probation and ordered to pay a $250 fine. She was given credit for 6 months’ time served.
According to court documents, Upshur pleaded guilty June 19 to misdemeanor possession of a controlled substance and felony conspiracy to deliver a controlled substance in separate cases. Numerous other drug-related felony and misdemeanor charges were withdrawn as part of a plea agreement.
Essence N. Wilson, 28, of Butler was sentenced to a total of 36 months’ probation and ordered to pay $1,565 in restitution.
According to court documents, Wilson pleaded guilty June 19 to possession of drug paraphernalia and criminal mischief in separate cases. Charges of terroristic threats, harassment and contraband were dismissed.
Brian J. Zinsmaster, 43, of Coraopolis was sentenced to 24 months in the county’s Intermediate Punishment Program, with a total of 270 days on house arrest with electronic monitoring, and ordered to pay a $1,000 fine and complete 100 hours of community service.
According to court documents, Zinsmaster pleaded guilty June 19 to one count of DUI and a summary count of DUI while license is suspended. Charges of possession of drug paraphernalia, possession of a small amount of marijuana, disorderly conduct and numerous summary violations were dismissed. Two counts of DUI were withdrawn.
