Defendant in neighborhood dispute receives probation

A dispute between neighbors over a dog netted a city woman six months on probation.

Belinda Lee Diaz, 38, pleaded no contest to making terroristic threats and was sentenced Thursday by Butler County Judge Timothy McCune.

A no contest plea means the defendant is not acknowledging guilt, but rather is choosing not to fight the allegations at a trial. However, the plea is weighed as a guilty plea at the time of sentencing.

Diaz’s defense attorney Jerry Cassady told the judge that his client accepted the plea offer from the county district attorney’s office because it involved a sentence without jail time.

“A firearm was involved in this incident,” he said.

Court records allege Diaz threatened a family from her neighborhood with a shotgun. The family was walking their dog at the time.

And investigators, according to court records, suspected the confrontation stemmed from an incident a week earlier when Diaz’s dog attacked the neighbor’s dog on the street.

Diaz initially faced additional charges of reckless endangerment and disorderly conduct that were dropped as part of the plea arrangement. Diaz also must pay a $100 fine.

Cassady told the judge there’s little chance of further conflict because Diaz no longer sees the neighbor in question.
