Charges against a 23-year-old man accused of confronting two people with a knife in a Sheetz bathroom had charges against him withdrawn after the witnesses would not agree to testify, according to the prosecution.

Damian Jamar Blystone, 23, had one felony count of aggravated assault and one misdemeanor count each of simple assault and terroristic threats withdrawn by assistant district attorney J.P. Kulzer in a Thursday, Sept. 3, preliminary hearing before District Judge Kevin O’Donnell.

Joshua Sean Young, 40, was also charged in the July 30 incident and failed to appear for his preliminary hearing Thursday. The hearing was held without him and O’Donnell dismissed his misdemeanor simple assault charge, but held two misdemeanor DUI counts and a third misdemeanor count of marijuana possession for court.

Butler Township police responded to an incident July 30 at Sheetz on Center Avenue and spoke with four witnesses. Blystone and Young arrived to Sheetz after the group, and Blystone followed two of them into the restroom where police said an altercation involving a knife occurred.

While police were interviewing the witnesses in the parking lot, Blystone and Young drove back through the parking lot and were stopped by police. Police said Young had marijuana in the vehicle and showed signs of impairment.

Young’s formal arraignment is scheduled for 1 p.m. Oct. 20 in Butler County Common Pleas Court.
