BNY Mellon, Occupy attorneys state case

PITTSBURGH — Attorneys for BNY Mellon and Occupy Pittsburgh cited the Bill of Rights and past court cases to a judge who will rule whether the protest movement should be evicted from a downtown park.

“This is a case that everyone who owns property can understand,” said Daniel Smith, a lawyer representing BNY Mellon. “Under the law, it is unfair for any political or social movement to seize the property of others.”

Jules Lobel, an attorney representing Occupy Pittsburgh, said the park was financed with public subsidies and is essentially a public space.
