An outburst in Butler County Court Tuesday resulted in new charges against a Slippery Rock man.

Kevin A. Brodie, 24, was charged by the Butler County Sheriff's Department with misdemeanor resisting arrest and disorderly conduct, following his blowup in President Judge Thomas Doerr's courtroom, which was witnessed by a Butler Eagle reporter.

Brodie, who was in court facing a bench warrant for failing to appear at a previous hearing on charges of misdemeanor possession of a small amount of marijuana and drug paraphernalia, became confrontational after arguing with Assistant District Attorney Terri Schultz regarding his case, and disagreed with Doerr's imposition of $1,000 in bail.

Schultz told the court that Brodie has had several bench warrants for failing to appear at court appearances scheduled in his case. Those bench warrants were later lifted in subsequent court appearances, and “then he never comes back,” she said.

Online court records state that bench warrants were issued Oct. 25 for failure to appear at formal arraignment the previous day, which was later lifted Nov. 2; Jan. 12 for failure to appear Jan. 10, which was lifted Jan. 24; and again March 3, for failure to appear Feb. 28, which is the warrant he was addressing Tuesday.

Brodie said he is a full-time student and was unable to come to court because he would be missing classes.

The affidavit of probable cause filed in Tuesday's incident states that during the proceeding Brodie became verbally confrontational with Schultz, interrupting her several times and raising his voice, before Doerr informed he was being held in contempt of court.

Brodie argued with Schultz, stating that he was not offered the county Accelerated Rehabilitative Disposition program, to which Schultz responded that he was not eligible due to his criminal history.

Following Doerr's bail order, Brodie allegedly resisted attempts by sheriff's deputies to take him into custody, yelling and screaming about his case. The document states that he began screaming profanities at the court and refused to leave the courtroom.

Brodie's objection was that his young daughter was present in the courtroom, and he attempted to pull away from deputies several times.

He was placed in handcuffs after he took a step toward Doerr and was escorted out of the courtroom, before continuing his outburst in a secured hallway, which could be heard in the courtroom.

The document states that several other deputies responded and Brodie was escorted to the holding cells, where he went limp and refused to walk.

The child was turned over to county Children and Youth Services personnel.

Brodie was arraigned on the new charges before Magisterial District Judge William Fullerton and bail was set at $5,000.

Butler County Prison officials confirmed that both bonds were paid, and Brodie was released.

A preliminary hearing is scheduled March 12.

Brodie was charged by state police in the initial incident for which he was in court Tuesday, after he was allegedly found with a marijuana cigarette during an investigation into a civil issue June 24 at a home on the 300 block of Kelly Boulevard.

Brodie admitted having smoked the blunt after troopers got there and smelled marijuana in the home, according to court documents. He turned over to police the half smoked blunt that was in an ashtray.

Brodie was acting as his own attorney in that case. It is unknown if he has retained counsel following the most recent incident.
