One charge dropped against man accused of firing gun near woman’s head

A prosecutor withdrew charges against a Butler man accused of firing a gun near a woman’s head in a residence.

Assistant District Attorney Ben Simon withdrew felony charges of discharging a firearm in an occupied structure against Dustin Timothy Lindsay, 39, as part of a plea deal related to an Oct. 26 incident at 420 N. Sixth Ave.

Two misdemeanor counts of recklessly endangering another person and simple assault were waived for court.

As part of his plea terms, Lindsay may not have contact with witnesses Benjamin Goodrum and Bryan Gillespie, and only nonthreatening contact with Natasha Goetz. Lindsay also may not be in possession of a firearm.

Lindsay’s formal arraignment is scheduled for 1 p.m. March 18 in Courtroom 5 of Butler County Common Pleas Court.
