Woman, 26, no longer faces felonies

CHICORA — Prosecutors have withdrawn the most serious charges against a Butler County woman accused of unloading a rifle at the pickup truck her brother was driving.

State police said 26-year-old Amber R. Cubbage on Dec. 6 repeatedly fired a .22-caliber rifle at the Ford Ranger, hitting it four times in the tailgate and twice in the hood.

Her big brother, Matthew N. Ford, 28, of Venango Township, was not hit or hurt in the shooting that played out shortly after midnight in front of Cubbage’s house on Windy Point Road in Marion Township.

Police believe a sibling feud motivated the altercation that turned violent after Ford drove up and down the road “burning tire and revving the motor” for 40 minutes, according to court documents.

Fed up with her brother’s actions, the defendant got a rifle and opened fire, police said.

Cubbage on Tuesday gave up her right to a preliminary hearing before District Judge Lewis Stoughton in Chicora.

The waiver came after Butler County Assistant District Attorney Russ Karl agreed to withdraw multiple counts of aggravated assault, the only felonies that Cubbage faced in the shooting.

Karl’s decision followed negotiations with the suspect’s attorney, public defender Maura Palumbi.

Cubbage, who is free on $5,000 bail, will now face only misdemeanor charges of shooting at an occupied vehicle, reckless endangerment and criminal mischief.

Karl declined to comment after the proceedings. Palumbi only noted her client was “very much the initial victim” in the altercation with her brother.

Police also charged Ford with misdemeanor disorderly conduct in the case.

Ford on Tuesday pleaded guilty before Stoughton to a reduced summary count of disorderly conduct. He was ordered to pay $300 in fines and court costs.

However, he still faces charges in Butler County Court that followed a drunken driving arrest less than 24 hours after the shooting.

Ford is currently being held in the Mercer County Jail on a state parole violation.
