Judge drops charges against man with autism

A Butler County judge found a Jefferson Township man facing assault charges to be incompetent to stand trial, dropping all charges against him.

Police charged Kenneth Connor Jr., 35, with aggravated assault, resisting arrest, disorderly conduct and harassment.

But Connor's lawyer, Joseph Kecskemethy, argued earlier this month before Judge William Shaffer that Connor is unable to comprehend the charges against him.

Kecskemethy presented testimony from a forensic psychologist, who said Connor is on the autism spectrum, has a low IQ and was suffering from a psychotic episode during the incident that made him experience delusions and possibly even hallucinations.

After the hearing, Shaffer ordered the case be dropped and wrote that he found Connor's “intractable cognitive disability prevents him from meaningfully assisting with his defense. Thus, he is incompetent to stand trial.”

The forensic psychologist Bruce Chambers also testified during the hearing that Connor's condition is a permanent state of being, and that a person's IQ cannot be increased nor is autism something that could be changed. Shaffer agreed with this assessment in his order: “As the defendant's cognitive deficit is an intractable condition, no treatment can be ordered to improve his condition to the point of competency to stand trial,” he said.
