Butler man sentenced to prison on drug charges

A Butler man convicted of nine felony and misdemeanor drug charges by a jury in January was sentenced Thursday to a lengthy prison sentence.

Tywann Raheem Windham, 37, was sentenced in Butler County Common Pleas Court to serve 102 months to 204 months in state prison for dealing crack cocaine and heroin.

Judge Timothy F. McCune sentenced Windham to consecutively serve 60 to 120 months for a felony charge of possession with intent to deliver, 21 to 42 months for a second count of the same charge, and 21 to 42 months for a third count of the same charge. He was given a concurrent sentence of 60 to 120 months for a felony count of conspiracy. No additional penalties were ordered for the remaining charges.

Windham’s estranged wife, Kari Lee Summerville, testified against him in a two-day trial in January. She faces similar charges, and was offered leniency in exchange for testifying. She has not been sentenced.

Both were arrested after the Butler County Drug Task Force executed a search warrant at her home on Virginia Avenue in March 2020. Summerville said both of them sold crack and heroin from the home for 11 years.

Public defender Joseph Leonard Smith argued that Summerville will be given a sentence of probation, but that both defendants are equally culpable. He asked for Windham to be sentenced to the 60-month minimum on each charge.

McCune said Windham’s history shows he was arrested 20 times and convicted 17 times as an adult. He said Windham knows the drug trade and the risks that go along with it.

Assistant District Attorney Benjamin Simon asked for a prison sentence of 168 to 432 months.
