Woman sentenced to prison

A Pittsburgh woman was given a prison sentence Thursday in Butler County Common Pleas Court for a 2020 traffic collision in Center Township that left her and both people in the other vehicle injured.

Kimberly Ann Summers, 30, of Pittsburgh was sentenced to serve 24 to 48 months in state prison after pleading guilty to two felony charges of aggravated assault by vehicle, and an additional 60 days in prison for her guilty plea to a charge of driving with a license suspended due to a previous driving under the influence case.

Judge Kelley Streib sentenced Summers, who participated in the hearing from the county prison through video conferencing.

On Oct. 7 around 9:50 a.m., Summers was headed east on Jamisonville Road in a Cadillac DeVille and failed to stop at a stop sign at the intersection of Route 308, and struck a Cadillac CTS that Dwayne Hartman, 56, of Butler was driving south on Route 308, according to state police.

Summers was flown by medical helicopter to UPMC Presbyterian hospital in Pittsburgh with serious injuries following the crash. The Unionville Volunteer Fire Department had to remove the driver's side door to get Summers out of her car.

A second helicopter flew Zackary R. Hartman, 20, of Butler, a passenger in the other vehicle, to Allegheny General Hospital in Pittsburgh. The collision threw him out of the passenger side door. Witnesses and emergency crews found him lying face down on the ground near the intersection.

At Summers’ preliminary hearing in May, Zachary Hartman testified that he missed about 20 days of work due to injuries from the accident. He said he had ankle, knee and back injuries, and received stitches to close a cut on his face.

Dwayne Hartman was taken by ambulance to Allegheny General Hospital. At the preliminary hearing, he said spent two days in intensive care and a total of seven days in the hospital with a head injury and broken ribs.

Streib said a victim impact statement was submitted. The statement was not read aloud in court.

State police initially charged Summers with two counts of aggravated assault by vehicle while driving under the influence and 12 other charges. The second-degree felony charges of aggravated assault by vehicle while driving under the influence were changed to third-degree felony charges of aggravated assault by vehicle.

Some of the other charges filed by police were withdrawn Thursday. Those charges were driving under the influence of a controlled substance and possession of drug paraphernalia. No action was taken on four summary traffic violations.
