Key witness subpoenaed

Man shot, killed in Sept. 2012

A defense attorney, again preparing for a city man’s homicide trial, on Monday subpoenaed one of the key witnesses when that witness appeared in court on her own legal problems.

Richard Neyman, 37, in April will defend himself against allegations that he purposely shot and killed Craig Haas, 45, on his city porch on Sept. 27, 2012.

Defense attorneys and prosecutors in January came minutes away from selecting a jury for Neyman’s trial. But the case had to be delayed while officials searched for 23-year-old Kimberly Summers, who is believed to have been with Haas in the hour before the shooting.

Neyman at the time of the shooting reportedly told investigators that he’d gone to Haas’ apartment in search of his girlfriend. When he arrived, Neyman allegedly claimed he was attacked by Haas and a gun that Neyman had went off, fatally shooting Haas in the chest.

Summers, described by the defense as a “key” witness, was missing in January. So the judge delayed Neyman’s trial until she could be found.

Summers was arrested last week on an unrelated criminal case: She is accused of violating probation on a 2012 simple assault conviction by failing to report to her probation officer for nearly a year.

Butler County Sheriff Mike Slupe said his office “utilized resources” to locate Summers. Butler officers retrieved Summers from the Allegheny County Prison on Feb. 17.

On Monday she appeared before Judge Timothy McCune to discuss the alleged violation.

The hearing was continued. However, while Summers was in the courtroom, Neyman’s defense attorney Charles Nedz served her a subpoena to appear at Neyman’s criminal trial.

Nedz declined to comment for this report.

Neyman’s trial is expected to last about a week and will include about 25 witnesses.

He could face life in prison if he is convicted of first-degree homicide.
