1 charge dropped against man accused of assault
A Gibsonia man accused of running over his girlfriend's leg had one of his charges dropped and will be monitored from home until his trial.
Raymond J. Silak, 41, appeared virtually for his preliminary hearing Wednesday. He was being held in Butler County Prison in lieu of $50,000 bail.
State police charged Silak on March 25 with felonies of aggravated assault and aggravated assault with a vehicle as well as related misdemeanors.
Silak is accused of punching his girlfriend multiple times during an argument and backing a vehicle over her leg, causing injuries. Prosecutors had photographs of those injuries in court Wednesday, which they shared with Lee Rothman, Silak's attorney.
Silak waived his right to a preliminary hearing. After the hearing, Rothman had no comment.
As Silak waived, the prosecution made some concessions on the case. First, they agreed to allow Silak to have nonmonetary bail, sending him home with electronic monitoring.
“He's not a flight risk,” said Assistant District Attorney Amanda Scarpo. “It serves better to know where he is, rather than to allow him to post (bail) and not know where he is.”
The prosecution also agreed to drop one of Silak's charges — the felony aggravated assault, a first-degree offense.
Scarpo said the witness, the woman who was allegedly beaten by Silak, did not appear in court Wednesday, and it appeared she may not be willing to cooperate.
With all other charges waived to court, the case remains intact, with the chief felony charge of aggravated assault with a vehicle still in play.
Silak is scheduled to appear for a formal arraignment June 1 in the Butler County Court of Common Pleas.
