No ruling yet on O'Malley appeal

The Pennsylvania Civil Service Commission has not yet issued a decision on the firing of the former executive director of the Butler County Housing and Redevelopment Authority.

Perry O’Malley was fired more than a year ago after the authority board accused him of abusing travel and sick time, neglecting his duties and using authority resources for private business.

O’Malley appealed his termination, resulting in a five-day civil service appeal hearing in November 2015.

Jack McGettigan, spokesman for the commission, said, “There is no decision yet. There isn’t a specific timeline for that.”

Odelfa Smith Preston, the civil service commissioner who heard the case, said in November that the goal was for the commission to make a decision within 90 days of receiving briefs from both sides’ attorneys.

However, that occurred in February.

McGettigan said that timeline is ideally what would occur.

“We try to do that,” he said. “It’s not a requirement or deadline.”

But a ruling could be forthcoming based on action in other cases. The commission issued decisions on June 9 and 13 for other hearings it held in October 2015.

McGettigan said once a decision is made, it would be posted on the Civil Service Commission section of the state’s website the next day.

During O’Malley’s hearing, he defended his tenure, which began in 1992. He pointed out the authority had 800 units, 17 employees and a $4 million budget at that time.

When O’Malley was fired, there were 2,500 units, 40 workers and a $15 million budget.

He also reactivated the county redevelopment authority, which had ceased operations in the 1980s.
