Court sentences man for child endangerment
A Butler man said he realized it was time for him to grow up as he was sentenced Thursday to various punishments in six cases.
The most serious case that Judge William McCune sentenced Alonzo J. Fleischer, 25, of Butler, for involved child endangerment.
Fleischer pleaded guilty to the misdemeanor Feb. 16, and McCune sentenced him to 11-and-a-half to 23 months in jail followed by three years of probation. Fleischer was immediately paroled after receiving 14 months of credit for time already served.
Fleischer told McCune that he is no longer committing crimes, to which McCune asked, “What's changed?” Fleischer responded that he knew it was time to grow up.
Fleischer was first charged in the case Oct. 15, 2018, after police said he neglected his baby, who was around 4 months old at the time. The mother of the baby, Brooke R. Fair Smith, 25, was also charged in the case.
According to police, the baby was born with neonatal abstinence syndrome due to Fair Smith using methadone and marijuana while pregnant.
When the baby was released from Magee Women's Hospital in Pittsburgh, according to investigators, the pediatrician treating him recommended visiting nurses make regular visits at the defendants' apartment to assess the child and, if needed, to administer care.
There were to be eight visits over a seven-week period. But nurses were only able to make two of those visits, police said, because Fleischer and Fair Smith would not answer the door or telephone, or return phone calls.
On Sept. 17, the baby was taken to Children's Hospital in Pittsburgh, according to one ChildLine report, because of concern for a brain injury.
An examination found the child had bilateral subdural hemorrhages that required neurosurgery. He also had three healing rib fractures.
The baby was taken to foster care and, the detective said, “is doing much better now and improving by leaps and bounds.”
McCune sentenced Fleischer in five other cases.
In one case, he was sentenced to six months to one year in jail for possession of a controlled substance. Fleischer was charged in the case Dec. 27, 2019, and pleaded guilty Feb. 16. He was paroled after receiving credit for time already served.
In another case, he was sentenced to one to six months in jail and a $500 fine for retail theft. He was charged Aug. 16, 2017, and pleaded guilty Feb. 16. He pleaded guilty on the same day to the following charges:
In a third case, he was sentenced to one to six months in jail and a $330 restitution order for retail theft. He was charged Aug. 18, 2017.
In a fourth case, he was sentenced to one to six months in jail and a $198 restitution for criminal conspiracy to commit retail theft. He was charged Aug. 18, 2017.
In a fifth case, Fleischer was sentenced to three months to one year in jail for flight to avoid apprehension. He was charged Oct. 16, 2018.
In all five of these cases, he was immediately paroled, and the sentences are running simultaneously.
