14-year-old testifies in indecent assault case
SLIPPERY ROCK — During a preliminary hearing Wednesday, a 14-year-old girl held firm in her accusations of being inappropriately touched on multiple occasions by a former Prospect councilman.
The girl testified in the courtroom of District Judge Bill O'Donnell in the case against David B. Stellfox, 74, about three alleged incidents that occurred more than two years ago.
Stellfox is charged with felony counts of corruption of minors and unlawful contact with minors, as well as a misdemeanor charge of indecent assault against a person younger than age 13.Stellfox was released on his own recognizance following his arraignment in January.On Wednesday, he entered the courtroom first, sitting next to his attorney, Michael Zunder.The girl's family entered next, sitting in the middle of the court's seating area. Once the hearing began, the girl entered. She was the only person to testify Wednesday, guided by assistant district attorney David Beichner.According to the girl's account, all three incidents occurred in Stellfox's home. She said she couldn't remember where the home was or when the events occurred, but she remembers the moments themselves.“I do not remember my age or anything,” she said. “I've never been able to pinpoint it.”The accuser said on the first two occasions they were alone at the home. She said Stellfox lured her to his bedroom and into his bed, where he touched her inappropriately.The girl said the third incident occurred while she was sleeping on an air mattress in Stellfox's living room. She said she felt his presence behind her and heard him making sounds.“I could feel him moving around behind me,” she said. “I just remember I was scared, and I didn't know what was happening.”During cross-examination, Zunder asked questions to establish the timeframe of the alleged incidents, what had drawn the girl to the bedroom and more details about the alleged behavior.After multiple objections from Beichner, Zunder asked O'Donnell to be allowed to approach the bench, and the three men retreated to the judge's chamber.During this time, the girl held her mask and a pack of tissues between her hands, clutched tightly with fingers laced. She stared at her feet.State Trooper Justin Werner, who filed the charges, sat on the prosecution's side a few feet from where the girl was seated. During this time, Stellfox appeared to occasionally look at the girl and at other times at the wall ahead.After the attorneys and O'Donnell returned, testimony resumed.The judge decided to move the case forward to the Butler County Court of Common Pleas.Stellfox was free to leave Wednesday, but he is on probation for a similar offense involving an 11-year-old boy.In that case, Stellfox pleaded guilty in June to misdemeanors of corruption of a minor and indecent exposure, and he was sentenced to two years of probation.Stellfox served on Prospect council from February 2010 through 2015.
