A pizza delivery driver is accused of backing his vehicle into a 9-year-old boy when backing into a driveway in Butler Township.

Nikolas James Anthony Oesterling, 18, of Fenelton, was charged July 7 with one misdemeanor count each of drug paraphernalia possession and marijuana possession and summary careless driving following a May 5 incident.

Police said they were dispatched to a residence on Homewood Drive for a report of the boy being struck by Oesterling’s vehicle. Police arrived and an EMS evaluation on the scene found the boy with minor injuries to his hips, right elbow and left knee.

Police said the boy’s parents declined to have him taken to a hospital by EMS.

Oesterling told police he was backing into the driveway for a delivery and didn’t see the boy until he struck him. Police said the boy was sitting in the driveway. After being struck, he ran into his home and yelled for his parents, police said.

Oesterling was also found with a small bag of marijuana and a small glass smoking pipe.

Oesterling’s preliminary hearing is scheduled for 10 a.m. Aug. 13 before District Judge Kevin O’Donnell.
