Couple charged with possessing 'bath salts'

Driver also suspected of DUI in crash

A Mercer County couple is facing multiple felonies for possessing “bath salts” stemming from a September suspected drunken driving crash in Muddy Creek Township that left one of them seriously injured.

State police Monday obtained arrest warrants for Malachi M. Graham, 24, of Grove City, and Ashley M. Robinson, 29, of Hermitage. Both are charged with three felony counts of possession of a controlled substance.

Graham also is charged with aggravated assault by vehicle while driving under the influence, a felony.

Police said Graham was driving a car north on Interstate 79 around 8:15 p.m. Sept. 9 when he crashed. Troopers found the badly damaged Toyota Solara in the center median.

A Portersville-Muddy Creek EMS crew already was treating Robinson, a passenger in the car that she owned, by the time police arrived. She was unresponsive, police said, and lying on the ground behind the vehicle.

Trooper David Wellington, the investigating officer, said that when he got there he saw Graham getting out of the car through the driver's side window.

A medical helicopter later landed on the highway and flew Robinson to UPMC Presbyterian hospital in Pittsburgh with serious injuries.

Graham, who allegedly appeared impaired, was taken by ambulance to the same hospital. Police described his injuries as minor.

Both defendants were treated and released the following day, Wellington said.

During their on-scene investigation, police learned that Graham was wanted on two bench warrants.

While checking the vehicle's glove box for registration and insurance information, Wellington said he found a bag of between 38 and 40 unknown pills. Behind the passenger seat, he also found a vape pen with THC wax inside it.

Additionally, police said, there were empty alcoholic beverage containers strewn throughout the car.

Police subsequently got a search warrant for Graham's medical records. Toxicology results showed his blood-alcohol level around the time of the wreck was 0.116 percent, documents said. A level of 0.08 percent is considered intoxicated under state law.

Wellington said lab tests indicated the seized pills were three kinds of “bath salts,” a synthetic stimulant and type of designer drug.

Bath salts are made from amphetamine-like chemicals, according to the U.S. Drug Enforcement Administration, and they are designed to mimic effects similar to those produced by cocaine, methamphetamine and MDMA, also known as “ecstasy.”

In addition to the felonies, both defendants are charged with misdemeanor possession of drug paraphernalia. Graham also is charged with DUI and 12 traffic violations, including driving with a suspended license.

It was unknown if either suspect has an attorney.

Court records showed that Graham has pending criminal cases in Butler and Mercer counties, including a DUI arrest Feb. 10 in Slippery Rock.
