Driver found asleep faces drug, DUI charges
State police said they found suspected methamphetamine and other contraband in the car of a suspected drugged driver arrested Saturday morning in northern Butler County.
Edward P. Smith, 33, of Brady Township, who is behind bars in lieu of $50,000 bond, is facing misdemeanor drug possession and driving under the influence of a controlled substance charges.
Trooper Philip Treadway was called about 9:30 a.m. for a welfare check for a man reportedly asleep in the driver's seat of a running car at a Route 8 store parking lot in Brady Township, police said.
The trooper found Smith apparently passed out in the car, which was still running. The defendant appeared to be impaired, and he was subsequently arrested for suspicion of DUI. He refused to submit to a blood test.
A search of the car, according to charging documents, turned up a plastic bag and a glass container both with suspected meth, a plastic container with suspected THC wax, and three plastic containers with suspected marijuana.
Additionally, police found suspected drug contraband, including three drug-smoking pipes, three glass tubes with residue, and two scales.
District Judge Lewis Stoughton arraigned Smith on charges of possession of a controlled substance and drug paraphernalia, possession of a small amount of marijuana and DUI, all misdemeanors. He also was arraigned on summary charges of driving with a suspended license-DUI related and driving a vehicle with an open container of alcohol.
Police noted this would be the defendant's second offense for both DUI and driving while suspended.
At the arraignment, Stoughton imposed a number of bail release conditions, including that Smith report to the county's adult probation office and be placed on pretrial supervision.
The defendant also must undergo a drug and alcohol evaluation, and abstain from drugs and alcohol, and he is barred from driving on public roads.
Online court records did not indicate if he has an attorney.
