Tender Care, U.S. Attorney reach settle over complaint

The U.S. Attorney for the District of Connecticut has reached a settlement with Tender Care Learning Centers over allegations the nonprofit violated the Americans with Disabilities Act.

The organization operates 22 early child care centers in Pennsylvania and Connecticut, including a location just over the Butler County line in Marshall Township, Allegheny County.

In a statement Tuesday, the U.S. Attorney’s Office said the settlement stems from an ADA complaint filed by parents of an epileptic child who alleged Tender Care would not administer prescription emergency rescue medication.

With the settlement, Tender Care will pay a total of $20,000 in damages to “certain individuals identified during the government’s investigation of this matter” who were harmed by the previous policy.

The attorney general’s office said the new Tender Care policy will implement policies, practices and procedures to administer medicine to children with disabilities. It will also train its employees on how to comply with Title III of the ADA, which governs discrimination on the basis of disability.

Also, Tender Care will be required to evaluate and grant reasonable requests for modification, a common standard used in the ADA, and will enact an emergency anti-seizure medication administration policy and procedure.
