Man will return, serve rest of time in county prison

A Butler man incarcerated in state prison is returning to the county's jail to serve out the remainder of his sentence related to five separate criminal cases, including police discovering him unconscious on a sidewalk after overdosing and, in another case, removing his electronic monitor bracelet in 2017.

Richard J. Dortman, 58, has been serving time at a state prison facility in Camp Hill since September, according to court documents. According to his lawyer, Joseph Smith, he was preparing to enter a state intermediate punishment program as part of his sentence when the state Legislature repealed the program.

Intermediate punishment programs are alternatives to prison or jail generally geared toward defendants facing alcohol or substance abuse issues. The programs often reduced defendants time behind bars and allow courts flexibility in tailoring a punishment aimed at helping defendants overcome addiction or other related issues.

Smith said Dortman's remaining sentence will be served in Butler County Prison and be equivalent to the scrapped state sentence.

Four of Dortman's cases date back to 2017, and in all of them he pleaded guilty to misdemeanor charges varying from DUIs and a simple assault to drug-related charges. Judge William Shaffer ordered Dortman's transport back to Butler County Prison to complete his sentence.

Smith said Dortman already served nine months between his incarceration in state prison and the county jail before that. Dortman most likely will only have to serve three more months, Smith said.

In the drug related charges, Dortman and Lili M. Szymecki, 39, of Butler were found unconscious on November 2017 by police on a sidewalk. A 911 caller reported a man and woman being dragged from a home and placed on the sidewalk.

Both appeared to have overdosed, police said, and they were both revived with Narcan. Police said they learned both were wanted on warrants. A search of Szymecki's purse turned up 50 stamp bags of suspected heroin, one bag of suspected cocaine, four drug-smoking pipes and two spoons, documents said. Dortman was allegedly found with four stamp bags and 10 empty bags of suspected heroin, a small baggie of suspected marijuana and a used syringe.

In Dortman's most recent case — from last year — he is still awaiting sentencing after pleading guilty Sept. 3 to obstructing administrative law and tampering with property.

Dortman was charged in this case after he escaped home detention by removing his electronic monitoring bracelet in April. He had been wearing the device since March 22 when he was released from the Butler County Prison as part of a 30-day parole sentence, according to county detectives.
