Jefferson Township man's drug case headed to court
A case against a 55-year-old Jefferson Township man for allegedly having four marijuana plants on his property will be held for higher court after a preliminary hearing Wednesday in Saxonburg.
State police said they seized two plants from the wood line Sept. 5 during a warrant search at Brett T. Carion's home on the 800 block of North Pike Road in Jefferson Township. Another two suspected marijuana plants were allegedly found in a garden behind the house.
The search turned up a marijuana pipe and marijuana bud, police said. On Wednesday, Trooper Kurtis Glasgow testified during a preliminary hearing at District Judge Sue Haggerty's court that Carion wasn't home at the time, but that he left his number for Carion, who called back Sept. 24.
Glasgow said Carion told them he “made a stupid mistake” and that he was “just growing the plants for someone else.”
The warrant for the house, Glasgow said, was based on an anonymous tip, but Assistant District Attorney Amanda Scarpo objected to Carion's lawyer, Charles Clark, questioning Glasgow about it. Haggerty upheld the objection.
Carion faces a felony charge of possession with intent to deliver a controlled substance and a misdemeanor charge of possession of a controlled substance. He is out on a $5,000 unsecured bond.
During Wednesday's hearing, Clark also noted that authorities never informed Carion of his Miranda rights when Carion called them Sept. 24. Additionally, he asked Glasgow if there was any indication of drug sales at the home, such as large sums of money or records of sales. Glasgow said neither of these were found.
