MUDDY CREEK TWP — A 63-year-old man was arrested for allegedly pointing a loaded handgun at a hunter Monday morning in an apparent property line dispute on the state's opening day of rifle deer season.

Russell J. Barkley Jr. is charged with felony and misdemeanor assault in the incident that happened about 10 a.m. at or near his home in the 300 block of West Park Road in Muddy Creek Township.

The victim told police that he believed he was hunting on Moraine State Park property when he shot a deer, according to court documents.

While field dressing the animal, he said the defendant drove through the woods and pulled up beside him in a pickup truck.

An argument ensued over property lines, police said, during which Barkley allegedly pulled a revolver.

“Barkley pointed the gun at the victim,” according to a police affidavit, “causing the victim to seek cover.”

Both men called 911 after the incident. The defendant, who uses a wheelchair for an unspecified medical condition, returned to his home. Police spoke to him there.

A search of his wheelchair, documents said, turned up a .38 Special revolver loaded with six bullets. Troopers said they also seized a plastic bag containing suspected marijuana.

District Judge Sue Haggerty arraigned Barkley on charges of aggravated assault, simple assault, possession of a small amount of marijuana and harassment.

At his arraignment, the defendant told Haggerty that he has a medical marijuana card.

Barkley remains free on $10,000 unsecured bail.
