Sentencing Court

The following sentences were handed down Thursday by Butler County Judge William Shaffer:

John L. Jr. Schnur, 48, of Butler was sentenced to six months of intermediate punishment for driving under the influence and must also pay a $1,000 fine. And for driving under the influence with a suspended license, Schnur was sentenced to 90 days of house arrest, a $1,000 fine and must serve 60 hours of community service. Schnur was originally charged on March 31 with two counts of driving under the influence, driving without a license, driving with a suspended license while under the influence, speeding, careless driving and reckless driving.

Scott Alan Wimer, 55, of Harmony must pay a $750 fine, serve six months of intermediate punishment and 60 hours of community service for his second time driving under the influence. He was originally charged March 28.

Jeffery Lamont Davenport Jr., 28, whose address is unknown, pleaded guilty to receiving stolen property and driving under the influence on drugs. He was sentenced to 6 to 12 months incarceration and a second incarceration charge of 72 hours to six months, along with a year long probation. Davenport received credit for time served, so he was immediately paroled on both incarceration charges and will not have to go to jail. He also must pay a $1,000 fine and serve 60 hours of community service. He was originally charged March 25 with failure to stop at a red light, three charges of failure to carry license, driving an unregistered vehicle and driving under the influence of a combination of drugs and alcohol.

Lara Alyse Elliott, 32, of Butler will undergo county probation for one year for possessing drug paraphernalia March 15. At the time, she faced the additional charges of possessing a small amount of marijuana and possessing a controlled substance.

Ashley Nichole Fuller, 28, of Butler will be under county probation for 24 months for manufacturing marijuana, which is a controlled substance. State police were looking for Fuller on a mental health warrant Jan. 28 when she allowed police to enter the home. Police found evidence of a marijuana-growing operation. Fuller was arraigned on felony and misdemeanor drug possession charges, misdemeanor counts of possession of drug paraphernalia and possession of a prohibited offensive weapons.

Christopher Frank Papale, 37, of Butler was taken away in handcuffs to Butler County Prison to serve 14 days in jail as part of a 60 month intermediate punishment sentence he received for his third driving under the influence charge Sept. 21. Once released, he will be under house arrest for 14 months as part of the larger 60 month punishment. Papale must also serve 150 hours of community service and pay a $2,500 fine. Another charge he received at the time of his arrest for an accident involving damage was dropped.

Jacob Joseph Harm, 21, of Barberton, Ohio, was sentenced to six months of intermediate punishment and 60 hours of community service. Shaffer allowed his sentence to be served in Ohio. He was caught driving under the influence Nov. 27, 2016, and originally faced additional charges of careless driving, speeding and a second driving under the influence charge with a controlled substance.

David Marcus Jack, 26, of Chicora was sentenced to 14 days of house arrest for driving under the influence. He also must serve a six-month intermediate punishment sentence and pay a $1,000 fine. When he was originally charged Nov. 12, 2016, he faced the additional charges of careless driving and disregarding a traffic lane.

William Elmer Lunn, 41, of Portersville was sentenced to 3 to 6 months in jail with a parole after 48 hours for driving under the influence April 29, 2017. He must also pay a $750 fine and do 60 hours of community service. His original charges of disregarding a traffic lane and failure to keep right were dismissed.

William S. Campbell, 68, of Butler was sentenced in two separate cases, one in which he pleaded guilty to driving under the influence and the other he pleaded guilty to two counts of possession of the controlled substance heroin and engaging in criminal conspiracy to manufacture heroin and cocaine. He was charged in the latter case on Feb. 2 and was sentenced to a maximum of 23 months in jail for the three charges. As part of his plea deal, several charges were dismissed, including possessing drug paraphernalia, possession of a controlled substance and a separate charge of criminal conspiracy. In Campbell’s DUI case, he must pay a $300 fine and serve a maximum of four days in jail that runs simultaneously with his other jail sentence. Afterward, he will be on probation for 176 days. He was arrested for the DUI on Nov. 21, 2017, and charged at that time with no rear lights and an improper stop.

Bryan Russell Greene, 52, of Butler will be on county probation for six months for possession of drug paraphernalia and for driving under the influence he must pay a $1,000 fine and was sentenced to a maximum of six months imprisonment, but because he received credit for time served, he was paroled immediately. He also must complete 60 hours of community service. The charges were made March 1 and several were dismissed, including reckless and careless driving, a small amount of marijuana possession and possession of a controlled substance.

Peter Daniel Gearhart, 53, of Saxonburg was sentenced to six months of intermediate punishment for driving under the influence March 6. He must also pay a $750 fine. For driving with a suspended license, he must pay a $500 fine and serve a 60-day intermediate punishment sentence that runs at the same time as the six-month punishment. Additionally, he has a 60-hour community service requirement.
