A Butler man was sentenced to probation Wednesday after being charged with resisting arrest, causing a police officer to use a Taser in January.

Mark W. Holmes Jr., 33, was sentenced to 10 months of county probation by Judge William Shaffer. He was ordered to pay court costs and $28.31 in restitution.

Holmes pleaded guilty to misdemeanor resisting arrest on May 2.

He was initially charged with summary public drunkenness, which was dismissed as part of the plea.

Butler police filed the charges after responding to a domestic incident at a home on Hickory Street on Jan. 1.

Police said Holmes had been sending threatening text messages and voicemails to his girlfriend, and was found to be intoxicated.

While officers were there, Holmes became “extremely irate” and began yelling at the woman about their relationship issues, according to a police affidavit.

Police eventually arrested Holmes for public intoxication. But when they tried to put him in handcuffs, court documents said, he pulled away and grabbed one of the officers by the chest, and a tussle occurred.

Police eventually had to use a Taser to subdue him.
