ADAMS TWP — Township police used a Taser on a Mars man on Saturday, after he allegedly fought with them when they found him intoxicated and hiding in his car.

James Foster, 54, is charged with public drunkenness, driving under the influence, aggravated assault, resisting arrest and obstruction of justice. He is in Butler County Prison on $50,000 bail.

At about 9 a.m., officers were called to the parking lot of Fleming Tire on Route 228, for reports of an intoxicated man at the parking lot, according to court documents.

Arresting officer Sgt. Edward Lenz and patrolman Aaron Zaliponi arrived on the scene and began checking the vehicles. According to court documents, they found Foster “crouched down over the center console,” of his vehicle, “attempting to hide from us.”

Zaliponi addressed the driver, later identified as Foster, and Lenz checked the passenger side, observing several 40 ounce glass beer bottles at least one of which was open. Other officers arrived.

“Foster was told several times to exit the vehicle, and he eventually complied, and as he exited the vehicle he was unsteady on his feet,” Lenz said.

Lenz removed beer bottles and open containers, including an open 40 ounce beer bottle and a second unopened one, from the vehicle, according to court documents.

Lenz said Foster tried to push past two officers who were trying to stop him. Lenz said he helped them restrain him against the side of his vehicle while Foster continued to fight with them, police said.

“I was able to draw my Taser and deploy it, striking Foster on the right side of the body,” Lenz said. “We were then able to get Foster on the ground.”

Officers then put Foster in cuffs and had him evaluated by EMS, documents say.

After a more thorough search of Foster’s vehicle officers found five empty 40 ounce bottles of Budweiser, one half empty 40 ounce bottle of Bud Light and one unopened 40 ounce bottle of Budweiser, documents say.

Foster was taken to UPMC Passavant Cranberry Hospital, where he was found to have a blood-alcohol level of .238 percent. Under Pennsylvania law a level of .08 percent is considered intoxicated.
