Man stuck on roof pleads guilty
A Sarver man pleaded guilty to a trespass charge in Butler County Court Monday, after being found stuck on the roof of a commercial building.
Timothy L. Livengood, 28, pleaded guilty to felony attempted trespass before Judge William Shaffer.
This was a straight, or open plea, leaving sentencing discretion up to the judge. The minimum sentence calls for 6 to 16 months, while the maximum calls for 3½ to 7 years in state prison.
Livengood is scheduled for sentencing April 26.
He was initially charged with two felony counts each of attempted burglary and attempted trespass. He was also charged with possessing an instrument of crime, two counts of criminal mischief, and loitering and prowling at night — all misdemeanors, after the incident in the 700 block of Ekastown Road Dec. 20.
Buffalo Township police said Livengood, armed with a pry bar, climbed up to the top of the building that houses the Colonial Clinic, Colonial Pharmacy and K & R Pizza, attempting to “gain access to the pharmacy to take drugs, according to court documents.
Shortly after his failed break-in, he soon found he was unable to get down off the roof.
Livengood admitted that when daylight came he hid behind the air conditioning unit “in hopes he would not be seen.”
The building's owner arriving for work Dec. 21 and noticed the flue stack had been removed and shingles were ripped up on the roof. She called a repairman, who subsequently discovered Livengood lying — and stuck — on the roof.
Two officers helped rescue him before arresting him.
Later that day, it was discovered that someone had tried to break into K & R Pizza at the same building. Police said it appeared a pry bar was used in a failed attempt to force open the back door.
Livengood also would admit to that crime, too, documents said.
He continues to be held in Butler County Prison on $10,000 bail pending sentencing.
