Sexual assault accusation leads to arrest

Woman charged with false report

Cranberry Township police arrested a woman accused of falsely claiming a North Braddock police officer sexually assaulted her.

Michelle Milliron, 36, of Cranberry Township, is charged with making a false report and unsworn falsification to authorities after she reported that then North Braddock Police Officer Michael Foley sexually assaulted her at the Hyatt Hotel in Cranberry.

Foley resigned from the department in July when authorities discovered an online post featuring a picture of Foley in uniform looking for sex with married women and women in committed relationships.

Foley denies that he posted the image.

As the controversy unfolded, Milliron arrived at the North Braddock police station to make her accusations.

“According to Milliron, she met with Officer Michael Foley at the Hyatt Hotel on April 8,” said arresting officer Sgt. Matthew Irvin in his report. “Milliron reported Foley sexually assaulted her when they met in a room in that hotel.”

Because the alleged events took place in Cranberry, the Cranberry police department investigated, interviewing both the accuser and the accused during the investigation.

“I met with Milliron on August 13, 2017, and she verified the report she provided to the North Braddock Police Department,” Irvin said in his report. “Milliron reported there was no contact with Foley following the assault and she made no effort to contact him.”

This turned out to be untrue.

After interviewing Milliron, Irvin met with Foley who admitted to meeting her at the hotel for a consensual sexual encounter, denying that anything illegal happened. He came prepared with evidence that supported his story.

Foley supplied Irvin with his cell phone, revealing a number of explicit photos and messages that convinced Irvin that both parties arrived at the hotel with similar intentions.

Irvin also found messages from Milliron to Foley after their encounter at the hotel, contradicting her story about ending contact with him after the encounter at the hotel.

“Following the meeting on April 12 ... Milliron sent 102 unanswered messages to Foley” as well as website links and explicit images, Irvin said.

Milliron told Foley she’d like to see him again, but he didn’t respond. Eventually she started threatening to talk to the police chief about him.

“U (sic) got one more chance to call me and if you don’t I’m going to report you because I’m such a good citizen,” she texted him. “ ... I’ll take you down. It’s not a threat it’s a promise.”

Armed with the texts and what he learned from the interviews, Irvin charged Milliron with making a false report.

Foley was cleared of the charges against him.
