A Butler man faces multiple assault-related charges following an incident on April 21 at Rock Ann Haven in Butler Township.

Derek Neil Hays, 26, was charged with aggravated assault, a felony, simple assault, disorderly conduct — engage in fighting, both misdemeanors, and harassment by physical contact, a summary offense.

According to a criminal complaint, Robert Issacs Jr. was at Rock Ann Haven with Lisa Stewart on April 21.

Ashton Dolan, Hays' girlfriend, said she said “hello” to Issacs and told him she was his banker, according to the complaint.

She said he ignored her, and a short time later came up to her and said “I need a dirty banker.” Dolan was sitting with her father, Sean Dolan, who she said told her to ignore Issacs.

She said Issacs repeated the words. The report states that Hays said he heard Sean Dolan telling Issacs to back up and to not speak to his daughter in that way.

Hays told police that he went over to Issacs, pushed him and proceeded to punch him in the face multiple times, according to the complaint.

The report states that Hays said he never kicked Issacs. He also told police that Stewart and others pulled him off Issacs.

Stewart said Hays was kicking and punching Issacs and that she tried to pull Hays off him, according to the complaint.

Issacs said that Ashton Dolan greeted him and told him she was his banker, and the next thing he knew he was covered in blood and being picked up off the floor, according to the report.

The complaint states that Issacs said he didn't know what happened but was told a male hit him from behind with a beer glass, and that there was glass all over the floor.

Issacs said he made it home and his children told him he should go to the hospital, so he went to Butler Memorial Hospital. He later told police he had seven stitches in his head for his injuries and that he had pictures of his injuries, according to the complaint.

Hays was referenced in the report as telling police that he did not hit Issacs with a mug or microphone. Dolan said Hays had a microphone in his hand because he was singing karaoke, but wasn't sure if he hit Issacs with it or not.

The report states that Hays said he realizes what he did was wrong, but that he felt Issacs' demeanor toward Dolan was hostile and that's why he did it.

He said he was not aware if Issacs had any additional comment to Dolan, but said Issacs is a “big guy” and was “towering” over Dolan and her father.

Hays was released on his own recognizance. His preliminary hearing is set for 9:30 a.m. Aug. 3 in the courtroom of District Judge Kevin O'Donnell.
