Shooting earns man prison time
A Butler man will serve up to 4 years in prison for firing a shotgun into a city apartment.
Dominic R. Hutchens, 19, appeared in Butler County Court Thursday on that case, in which he pleaded guilty to conspiracy to discharge a firearm into an occupied structure.
His 2- to 4-year jail sentence, issued by Butler County Judge Tim McCune, also covered Hutchens’ guilty pleas in a strong armed robbery and a drugged driving incident.
According to court records related to the shooting incident, Hutchens was among a group of men who drove to Colleen Biondo’s apartment in the 400 block of West New Castle Street on Oct. 5, 2014.
Hutchens fired a sawed-off shotgun that shattered a window. No one was hurt, but the gunshot narrowly missed Biondo’s 6-year-old son who was sleeping on a love seat inches below the window, according to court records.
The allegations in the robbery case occurred four days earlier, when Hutchens and another man reportedly took money from a 33-year-old Butler man who had just withdrawn $700 from an automated teller machine.
Hutchens, who had 430 days credit at the time of his sentencing, successfully asked the judge to fashion his prison time so that he may stay in the county jail instead of a state prison. His defense attorney Dennis McCurdy made the request, saying the defendant’s main source of support is his grandmother who would be troubled in trying to visit any of the state facilities.
In addition to the prison time, the defendant was ordered to pay $450 in restitution to the victim in the shooting case and $750 to the victim in the robbery case.
In the case of drugged driving, which was filed by state police Jan. 20, 2015, the defendant also must pay a $1,000 fine and serve on a litter pick up crew as well as 60 hours of community service.
