Township sued overflooding
CONNOQUENESSING TWP — A couple of residents are suing the township for $12,000, claiming that it caused flooding and damage on their property.
Richard and Carol Howryla, who live on 12.5 acres on Whitestown Road, filed a complaint in district court Friday seeking money for damages and time spent cleaning up.
Richard Howryla claims in the complaint that during the summer of 2013 the township made modifications to the water run-off and channeling system on Whitestown Road, which led to water being improperly channeled onto his property.
In June 2014, rain and stormwater flooded the site, causing damage to the property, home and personal property.
The township is liable in both trespass and negligence, according to the complaint.
Andrew Menchyk, the township’s solicitor, Monday declined to comment about the lawsuit.
In district court, the defendant does not need to file a response, but will notify the court of its intent so that a hearing can be scheduled, he said.
