Man receives 3 to 20 years

He had sex with 14-year-old girl

A 38-year-old Allegheny County man claimed he was so stoned on prescription drugs and drunk that he was “close to comatose” and didn’t recall having sex with a 14-year-old girl in Evans City.

“I was completely intoxicated and blacked out from narcotics or this would have never happened,” Anthony T. Biondo claimed in Butler County Court on Thursday.

But Judge Timothy McCune, who alone decided Biondo’s punishment for that crime as well as the indecent assault of a different 13-year-old girl, wasn’t impressed.

“I’m not buying that,” the judge said, just before sending him to state prison for 3 to 20 years.

According to court records, Biondo of Penn Hills on Nov. 30 was in a house full of people and sleeping in the same room as the 14-year-old. He moved from a couch to the love seat, where the girl was sleeping, to assault her.

He then fondled a different girl in the same room, according to court records.

Biondo pleaded guilty to two counts of statutory sexual assault and one count of indecent assault.

Biondo’s attorney Jose Hernandez Cuebas told the judge that even though his client didn’t recall the events, he accepted responsibility based on the findings of different crime reports.

Biondo, a single, unemployed father of children ages 8 and 12, had urged the judge to reduce his punishment because he claimed he remembered nothing between the time he fell asleep on the couch and waking up in a hospital two days later.

“It kills me to know this happened,” he told the judge.

But Assistant District Attorney B.T. Fullerton successfully opposed a light sentence, noting that after the assaulting the girls, Biondo drove to his own Penn Hills home where police arrested him and charged with resisting arrest and public drunkenness.

The judge, after listening to both arguments, said he didn’t agree with Biondo’s excuse that he couldn’t control his actions because of his intoxication.

“That would make it even scarier,” the judge said.

A member of the state’s Sexual Offender Assessment Board evaluated Biondo and determined that he does not meet the criteria to be deemed a sexually violent predator. Still, due to the nature of the crimes, Biondo must register his whereabouts with state police for the rest of his life.
