Registered sex offender accused of violating law

Police say work sites not listed

BUTLER TWP — A home builder and developer, who is a registered sex offender, is accused of failing to report several construction sites that his company is working on in southern Butler County.

State police on Wednesday charged Timothy Drew Kelly, 58, of Worth Township with failing to comply with registration requirements, a felony, under Megan's Law.

According to state law, court-deemed sexual offenders must register personal information with state police.

That mandated disclosure includes an offender's home address, employment information, vehicle registration, telephone numbers and social media websites.

Police said Kelly, owner of T.D. Kelly Company, failed to list four work sites being development by his company, which is based on his home's estate of more than 65 acres.

Charging documents identified the building sites in Gotham Court in Adams Township; on South Jefferson Street in Zelienople; in Wakefield Estates in Cranberry Township; and in Meredith Glen Estates in Adams Township.

Additionally, police said Kelly did not immediately report a Harley-Davidson motorcycle he recently acquired nor did he register a new Facebook account.

Kelly was registered under Megan's Law on Oct. 29 after he pleaded guilty in Allegheny County to indecent assault, a misdemeanor, court records showed.

In exchange for his plea, prosecutors withdrew other charges.

He was sentenced to 2 years' probation.

Kelly is a Tier 1 sex offender, the lowest classification, meaning he is required to verify his address and other information with state police annually for 15 years.

Kelly's attorney, Stephen Colafella of Beaver County, did not immediately return a telephone call Friday.
