City man faces trial after 6th DUI arrest
A Butler man is headed for trial on charges stemming from his sixth drunken driving arrest.
If convicted, Danny M. Bragg, 36, faces up to five years in state prison.
Bragg on Monday waived his right to a preliminary hearing before District Judge Pete Shaffer in Butler on charges of driving under the influence of alcohol and drugs, driving without insurance and careless driving.
Butler police arrested Bragg after they said he lost control of his car about 6:50 a.m. Feb. 1 and crashed into a retaining wall and mailbox in the 800 block of Center Avenue.
Toxicology reports later showed Bragg’s blood-alcohol was 0.188 percent, or more than double the state’s 0.08 percent legal limit, according to court documents.
Police said he also had marijuana in his system.
Bragg’s latest DUI arrest came less than seven months after his release from state prison for his fourth and fifth drunken driving convictions.
Butler County Judge Tim McCune on Feb. 2, 2012, sentenced Bragg to 18 to 36 months behind bars followed by 42 months of probation, for those prior DUIs, both in Butler, that occurred in January and February 2011.
Bragg was paroled from prison on July 22, 2013, and placed in the Sharon Community Corrections Center in Mercer County, where he remained for an unspecified period of time before his release, Butler County Court records state.
The center, which is a half-way house under the supervision of the Pennsylvania Department of Corrections, aims to reintegrate offenders into the community.
Those at the center are allowed out during the day for work, job searching and community service.
Under the state’s DUI law, Bragg could get 1 to 5 years in prison and a fine of $2,500 to $10,000, if convicted.
He is in the Butler County Prison for a state parole violation.
