Attorney general's office files suit against contractor
PITTSBURGH — The state attorney general’s office has filed a consumer protection lawsuit against a Butler County-based home improvement contractor.
The lawsuit seeks to ban Horniacek Contracting and its president, Stephen Horniacek, 44, from the home improvement business until all court-ordered restitution, costs and penalties are paid.
In the 15-page lawsuit, the Summit Township company is accused of failing to finish one job and accepting a down payment but never returning to another.
The lawsuit further alleges that a different job was completed “in a manner inferior to or below the standard of that agreed to in the consumer’s contract.”
The lawsuit also alleges the company accepted deposits from consumers in excess of the amount permitted by law, failed to include legally required disclosures in its contracts and failed to maintain legally required insurance.
The lawsuit indicates the attorney general’s office believes other people have been victimized by the business, but have not filed complaints.
Attempts to reach Horniacek for comment were unsuccessful.
Both Horniacek and the business list the same address: 168 Brinker Road.
The lawsuit was filed in Allegheny County Court, apparently because it is the home county to at least one of the alleged victims.
The lawsuit alleges that criminal charges are pending in Allegheny and Westmoreland counties related to the same alleged conduct.
According to court records in Allegheny County, Indiana Township police filed charges of deceptive business practices and theft in December. In Westmoreland County, North Huntington Township police filed charges of theft in September, and New Kensington police filed charges of deceptive business practices and theft in March.
All of the cases are pending.
