PITTSBURGH — Federal prosecutors have notified a U.S. district judge that they won't seek the death penalty against a woman who fatally shot an FBI agent.

Forty-year-old Christina Korbe of Glenshaw is accused of shooting FBI Special Agent Samuel Hicks as he and other officers came to arrest her husband on drug charges at their home on Nov. 19.

Korbe acknowledges shooting Hicks, but says she believed police were intruders and feared for her two children. Prosecutors say Korbe knew Hicks was an officer.

She's being held in the Cambria County jail.

PITTSBURGH — State health officials say a Pittsburgh-area man with swine flu has died.The health department says the 27-year-old Allegheny County man died several weeks ago of complications of swine flu. His name wasn't released.More than 300 confirmed cases of swine flu have been confirmed in Western Pennsylvania this year.

YORK — Police say a man seen with a gun near a York elementary school was simply protecting his pigeons from cats, but not before a sighting prompted the school to lock down and send children home.York City Police Capt. Wes Kahley said Tuesday the man was using a BB gun to shoot the cats that were attacking the pigeons he raises for a living.Kahley says the man did not commit a crime, but exercised bad judgment.School Superintendent Sharon Miller says the report of a gun-wielding man outside Alexander Goode Elementary School came in at 8 a.m.Police and county sheriff's officers surrounded the building with about a dozen vehicles.
