Last jurors selected for farmer's trial
Lawyers on Friday afternoon picked the final few jurors to hear the trial of a Cherry Valley farmer accused of murdering his wife and her boyfriend last summer.
Nearly 200 people were summoned to the Butler County Courthouse Thursday and Friday before the seven-man, five-woman jury was selected for James Borchert's trial.
Two alternate jurors, a man and a woman, also were picked to hear the testimony and fill in if anything goes amiss with any of the jurors.
Borchert has pleaded not guilty to two counts of homicide.
He is accused in the August 2007 shooting deaths of 42-year-old Esther Borchert and her boyfriend, 49-year-old Lonnie Schwab Sr.
Borchert allegedly told state police he didn't regret killing the couple because his wife told him she planned to divorce him and force him to sell his 140-acre family farm.
The defendant sat in the courtroom during the past week as attorneys for both sides questioned each potential juror. More than 80 people were questioned Thursday.
Borchert, dressed in a sports jacket and slacks, did not speak during jury selection.
Afterward, defense attorney Al Lindsay told Judge William Shaffer that Borchert is out of money and is requesting that the court pay the costs of a psychiatrist who earlier interviewed Borchert.
The doctor will not be testifying, Lindsay said. However, attorneys named more than 20 other people who could be called as witnesses.
Prosecutors initially planned to seek the death penalty in the case. But weeks ago, that decision was reversed, and now the harshest penalty Borchert could receive if convicted is life in prison.
The trial is expected to start Sept. 15 and last a week.
