Sex offender back in prison

Butler police arrested a registered sexual offender for failing to notify authorities that he had moved to a new apartment in the city.

But officers on Tuesday filed an additional charge against Donald Joseph Kester after they found a 14-year-old girl at the defendant's Standard Avenue apartment.

Kester, 24, is charged with failure to comply with the conditions of Megan's Law — the law that tracks the whereabouts of sexual offenders. He also faces a charge of corruption of minors.

He is being held in the Butler County Prison on $5,000 bail. Apreliminary hearing is set for Monday before District Judge Pete Shaffer.

Kester is listed on the state police Web site as a sexual offender stemming from a 2005 felony conviction in Butler County for photographing a child in a sex act.

Under the terms of the law, Kester must annually confirm his address with state police. He also must register whenever he moves, changes employment or enrolls in school.

But Butler police recently learned that the defendant had moved from an apartment on New Castle Street to his current home on Jan. 15, without immediately notifying state police.

Last week, officers also received a call that a 14-year-old girl was at Kester's new apartment.

Police on Friday found him at the apartment. But, documents said, he twice denied anyone else was inside.

The defendant allowed an officer to search the apartment. The officer found the 14-year-old girl standing in the bathroom with the door open.

Kester first told police he believed the girl was 18; however, he later acknowledged he knew she was a minor.

Butler County Court records showed that Kester in November 2005 admitted he took a photograph of a 17-year-old girl lying naked on a bed.

Kester, who was then living at his parents' house in Adams Township, was sentenced to 6 to 12 months in the Butler County Prison, followed by 7 years' probation.

Butler County Judge William Shaffer also sentenced Kester at the same time to additional probation stemming from two separate cases filed by Adams Township police.

The defendant admitted in one of those cases that he illegally cashed a check owned by his brother, according to court records. He pleaded guilty to a felony count of forgery and was sentenced to 4 years' probation.

Kester, in the other case, admitted he walked into a woman's home in Adams Township and stole $17 worth of quarters. He pleaded guilty to defiant trespass and receiving stolen property, and was given another year of probation.

But in 2007, he was sentenced to 4 to 8 months in Butler County Prison for violating the conditions of his parole in those three 2005 cases.
