Daniyah Jackson died at Pittsburgh's Children Hospital on Saturday, two days after the alleged assault. The Allegheny County medical examiner's office Sunday ruled the death a homicide, saying the youngster died from multisystem organ failure precipitated by her injuries and the assault.

Clinton Smith, 30, of Pittsburgh, the mother's live-in boyfriend, was charged with homicide on Monday.

He had previously been charged with rape and other offenses.

The mother told police she left the baby with Smith on Thursday morning when she went to her job as a waitress.

The mother found the baby unresponsive when she returned home at about 9:30 p.m. and called paramedics.

A preliminary hearing in the case was scheduled for Wednesday.
