Sentencing Court

County Judge William R. Shaffer handed down the following sentences Thursday:

Darin Edward Gillott, 54, of Butler was sentenced to 5 years in the county’s Intermediate Punishment Program after pleading guilty Oct. 3 to DUI. He was also ordered to pay a $1,500 fine and complete 100 hours of community service. Gillott was arrested on Jan. 4 and initially faced two DUI charges and a turning movement citation.

Douglas A. McAnallen, 55, of Lyndora was ordered to pay a $30 fine after pleading guilty Oct. 3 to disorderly conduct. He was charged April 22 with criminal mischief, terroristic threats, simple assault and disorderly conduct.

Phillip Anthony Libecco, 63, of Rimersburg was sentenced to 3 to 12 months in jail followed by 9 years of probation and must register as a sex offender for life, after pleading guilty May 21 to corruption of minors and indecent assault. On May 23, 2017, police arrested Libecco on charges that he molested a young girl nearly eight years ago. He originally faced a felony charge of aggravated indecent assault of a person less than 13 years old, and misdemeanor charges of indecent assault of a person less than 13, child endangerment and corruption of minors.

Anthony James Klingensmith, 33, of Butler must pay a $100 fine serve 2 years of probation after pleading guilty Oct. 3 to simple assault. A charge of endangering the welfare of a child was dropped as part of a plea deal. Klingensmith was originally charged on May 30.

Shane Joseph Carr, 27, of Harrisville was sentenced to pay a $500 fine and serve 6 months of house arrest and 2 years of probation after pleading guilty Oct. 25 to carrying a firearm without a license. He was charged on March 23 with speeding, failure to use a seat belt, two counts of possessing drug paraphernalia, possession of marijuana, and altering an identification mark. Those charges were dropped as part of a plea deal.

Nathan Yates Sherer, 37, of Petrolia was sentenced in two cases, both of which were DUIs. In one case, in which he was charged on Sept. 9, 2017, he must serve 5 years in the county’s Intermediate Punishment Program, complete 100 hours of community service and pay a $1,500 fine. He pleaded guilty on Oct. 25 to the charge. In the other case, in which he was charged on Feb. 27, he must serve another 2 years in county IPP, pay a $500 fine and complete 60 hours of community service. In this case he pleaded guilty on Sept. 5.

Shane Patrick Miller, 28, of Butler was sentenced to 3 years’ probation after pleading guilty April 27, 2017, to three counts of possessing drug paraphernalia. He was also initially charged Aug. 26, 2016, with three counts of possession of a controlled substance with intent to manufacture or deliver. Those charges were dropped as part of a plea deal.

Howard Lawrence Watson, 43, of Harmony was sentenced in two cases concerning driving under the influence. In one he pleaded guilty Aug. 1 to DUI and driving without a license on Sept. 17, 2017, and was sentenced to 5 years in the county’s Intermediate Punishment Program, must pay a $200 fine and complete 50 hours of community service. In the second case he pleaded guilty Aug. 1 to DUI and driving without a license on Oct. 27, 2017. In that case he was sentenced to 2 years in the county IPP, must pay a $500 fine and complete another 50 hours of community service.

Audrey Marie McKivigan, 28, of Butler was sentenced to 6 months in the county Intermediate Punishment Program and must pay a $300 fine after pleading guilty on Jan. 30, 2017, to DUI. In a second case she pleaded guilty Jan. 30, 2017, to receiving stolen property, and was sentenced to 2½ years of probation, ordered to pay more than $7,000 in restitution and complete 50 hours of community service. In a third case she pleaded guilty to possession of drug paraphernalia was sentenced to 1 year of probation and must pay $50 in restitution. Charges were initially filed against her on Oct. 24, 2016.

Brandon D. McCaskill, 24, of Duquesne was sentenced in two cases. He pleaded guilty Oct. 3 to possessing heroin with the intent to sell it, and was sentenced to 1 year to 30 months of incarceration in state prison. In a second case he also pleaded guilty Oct. 3 to possession with intent to manufacture or deliver a controlled substance, and was sentenced to 6 months to 2 years in state prison.
