A Butler judge Tuesday denied a bail reduction request “to a reasonable and fair amount” from a lawyer representing an Ohio man being held in Butler County Prison on drug charges.

Marshall A. Grimes, 39, of Columbus is being held in the jail on $750,000 bail after he was arrested on Dec. 11 in Butler. City police got a report of a man who had pulled a gun on his girlfriend. When police arrived, they searched the apartment where Grimes was, uncovering a stolen gun, a shopping bag with cocaine and crack-cocaine. The estimated street value of the seized drugs is $10,000.

During the hearing to reduce Grimes' bail, Assistant District Attorney Terri Schultz noted that Grimes has prior convictions for aggravated assault and aggravated assault with a vehicle. She said her office might add charges.

But Grimes' lawyer, Michael John Carland, said that his client isn't violent.

“The underlying charges with the gun and the cocaine, there's no violence, incident of threat nor victim,” Carland said. “We don't have any violence here.”

Carland also argued that Grimes is not a flight risk because he has a son who lives in the county. He asked the judge to reduce the bail to $50,000.

Grimes faces felony charges of possession with intent to deliver a controlled substance, felons not to possess firearms and receiving stolen property.
