Inmate accused of raping cell mate

A Butler County Prison inmate stands accused of raping and abusing his cell mate, who is 75 pounds lighter.

The defendant, 19-year-old Dorian D. Holmes of Pittsburgh on Thursday was charged with rape, sexual assault and two counts each of involuntary deviate sexual intercourse and aggravated indecent assault.

Holmes has been in the prison since June 5, when he was accused of breaking out of his room at Western PA Child Care in Allegheny Township. Holmes, who at the time allegedly had a so-called “shank,” a homemade weapon constructed from the metal spine of a notebook binder, later pleaded no contest to being an inmate with a weapon. He is serving a 3- to 12-month sentence.

According to court records, the victim, a 20-year-old man then incarcerated on a drunken driving charge, became his cell mate in July.

According to an affidavit of probable cause filed by the Butler County detectives, the victim asserts Holmes at first only “bullied” him including smearing toothpaste on him and not allowing him out of his bunk bed.

Within two days, the victim said, Holmes escalated to physical violence, including putting him in a headlock. The victim said he offered to give Holmes his prison meal trays to stop the violence. When it didn't stop, the victim offered to have $35 placed in Holmes' prison account. The victim — who weighs 120 pounds, according to court records — said he continued to increase the offer until he hit $500.

Holmes--- who weighs in at just under 200 pounds, according to court records — is accused of saying he didn't want the money, he wanted the victim to remove his clothing.

The victim alleges he said no, but started to black out from the choking. Holmes then allegedly sexually assaulted him in several manners, according to court records.

The assaults continued until a fellow inmate alerted a corrections officer who removed the victim, who was later transported to Butler Memorial Hospital, according to court records.

Court records say the inmate who alerted the corrections officer also gave a statement to investigators saying he heard the victim offer Holmes his food trays and later saw the sexual assault.

Court records say when Holmes was interviewed by investigators, he acknowledged choking the victim and giving him “body shots” because he “was always touching my stuff,” specifically his toothpaste. However, the defendant reportedly denied any type of sexual assault.

Holmes was arraigned by District Judge B.T. Fullerton. The defendant still is incarcerated on the original case, and bail in this new case is set at $100,000.

Holmes did not have legal representation during the arraignment, and attempts to reach the attorney who represented him in the first case were unsuccessful.

Butler County Prison warden Joe DeMore, when contacted for this report, said the prison houses people strictly by security level, the weight of the inmates is not a factor.

During the incident, DeMore said protocol was followed once the other inmate notified the prison about the incident.

“He notified the CO (corrections officer),” DeMore said. “The CO immediately separated them (Holmes and the alleged victim).”

Court records indicate the victim is not currently an inmate.
