Man receives 3 to 20 years

A 38-year-old Allegheny County man claimed he was so stoned on prescription drugs and drunk that he was “close to comatose” and didn’t recall having sex with a 14-year-old girl in Evans City.

“I was completely intoxicated and blacked out from narcotics or this would have never happened,” Anthony T. Biondo claimed in Butler County Court on Thursday.

But Judge Timothy McCune, who alone decided Biondo’s punishment for that crime as well as the indecent assault of a different 13-year-old girl, wasn’t impressed.

“I’m not buying that,” the judge said, just before sending him to state prison for 3 to 20 years.

According to court records, Biondo of Penn Hills on Nov. 30 was in a house full of people and sleeping in the same room as the 14-year-old. He moved from a couch to the love seat, where the girl was sleeping, to assault her.

He then fondled a different girl in the same room, according to court records.

Biondo pleaded guilty to two counts of statutory sexual assault and one count of indecent assault.
