Man allegedly kicked in door to punch neighbor

A Butler man is headed to county court after an alleged confrontation with his neighbor.

Butler City Police filed charges last week against Mark A. Lilley, 29, who is accused of kicking in his neighbor's door and assaulting one of the people living there.

Following his arraignment Sept. 12, Lilley was placed in Butler County Prison in lieu of $10,000 bail.

Appearing virtually Monday, Lilley waived his right to a preliminary hearing, but his public defender, Michael McFarland, worked with prosecutors on a nonmonetary bond.

District Judge William Fullerton granted the bond while maintaining two conditions. The first requires Lilley to wear a SCRAM device, which monitors alcohol use, and the second prohibits Lilley from contacting the neighbors he is accused of confronting.

According to charging documents, police responded around 12:29 a.m. Sept. 12 to a home on the 300 block of West Diamond Street for a report of a burglary and assault.

Police said the neighbors, a man and woman, told officers Lilley had knocked on their door.

“When (the woman) inquired as to who was knocking, a male voice replied, 'The police,'” said the officer in the affidavit.

Police said the couple then opened the door to Lilley, who appeared inebriated and began arguing with them. Police said the man tried to shut the door, but Lilley kicked it in, which slammed the door onto the woman's arm.

According to police, after another brief argument the man tried to shut the door again. Police said Lilley kicked the door in a second time, walked into the apartment and punched the man in the face before fleeing.

Police said during their investigation, one of the neighbors spotted Lilley near the farmers market and pointed him out to officers.

Police set up a perimeter around an area of a few houses in the vicinity of Vogeley and Race streets after residents reported seeing Lilley in backyards there.

“(Another officer) and I were standing on West Vogeley and Race streets, when (Lilley) did round the corner and sprint in our direction,” police said.

Police said he did not obey commands to stop.

“He continued to run toward us, and I deployed my Taser, striking him and forcing him to the ground,” police said.

Lilley is expected to appear for a formal arraignment Nov. 16 in the Butler County Court of Common Pleas.
