An alleged trespasser is headed for court on charges that he broke into the same vacant house in Butler twice in less than two months.

Andrew J. McCue, 33, waived his preliminary hearing Monday in both cases. He is charged with two felony counts of trespass and a misdemeanor count of possession of drug paraphernalia.

Butler police said they arrested McCue in the latest case after Armco Credit Union workers reported finding a squatter in the house on the 300 block of West Penn Street around 10 a.m. March 18.

The credit union owns the house.

The defendant admitted that he broke in through the basement door and stayed the night there, according to charging documents.

McCue was arraigned on a charge of trespass and placed in the Butler County Prison on $10,000 bail.

Seven weeks earlier, police had arrested McCue for allegedly breaking into the same house. In that case, police said, he was found with a woman.

He told police, documents said, that he and the woman used a piece of wood to pry open the basement door.

Police said they caught him with eight syringes and three empty stamp bags of suspected heroin.

He was arraigned later that day on charges of trespass and possession of drug paraphernalia, and released at that time on $6,000 unsecured bail.

McCue gave up his right to a preliminary hearing Monday at the office of District Judge William Fullerton in each case. In exchange, prosecutors agreed to reduce his bail and he was allowed out of jail on his own recognizance.

His formal arraignment in Butler County court in both cases is scheduled May 21.

Patrick Casey, McCue's attorney, declined comment Tuesday about the charges against his client.
