Man asks for bond to be reduced; judge raises it

Charges include assaulting wife

A county judge Tuesday refused to release a jailed man accused of beating his wife three times and instead raised his bond.

“Given the repeated alleged acts of violence against the same victim, I don't feel comfortable releasing him,” Judge Timothy McCune said.

Leo R. Mullen, 53, is charged in three incidents involving alleged attacks on his wife. McCune raised the bond on two of his cases dating to March and July to $50,000.

In his most-recent case, police said he clubbed his wife in the head with a bottle of vodka during a domestic dispute at their home in August. The woman needed treatment at Butler Memorial Hospital for an open head wound following the alleged incident.

He was charged with felony aggravated assault and a misdemeanor simple assault and his bond was initially set at $15,000.

Mullen first was arrested in March after he allegedly punched his wife in the face at least twice during a domestic dispute at their home on the 400 block of East Pearl Street.

Police said the victim had a swollen left eye and she was bleeding from a cut on her left cheek.

A search of Mullen turned up eight Suboxone strips in one of his coat pockets, according to court documents. He does not have a prescription for the drug, police said.

He was arraigned March 5 on charges of simple assault and possession of a controlled substance, and placed in the Butler County Prison in lieu of $3,000 bail. On March 11, he was released on a nonmonetary bond, allowing him to be released.

In July, Mullen was again arrested after he allegedly punched his wife in the face during a domestic dispute at their apartment on the 300 block of West Jefferson Street. The woman suffered redness and swelling around the left eye.

Mullen fled the home, but police later found him in a nearby vacant apartment. District Judge Bill O'Donnell arraigned him July 20 on a charge of simple assault.

Mullen was placed in the Butler County Prison in lieu of $10,000 bail following arraignment. The charge led his March nonmonetary bond to be revoked and reset at $5,000.

On July 20, he posted that bond and the bond on his July case was changed to a nonmonetary bond. By Aug. 7, he was back in jail a third time for the alleged bottle attack. His bond was set at $15,000.

On Tuesday, his lawyer, public defender Kimberly Hudak, requested that his bond be reduced in the August case.

Assistant District Attorney Terri Schultz, who is prosecuting the case, asked McCune to deny the request, citing Mullen's history. “My concern is he moved up from simple assault to now we have aggravated assault, all on the same victim. So, I would ask his bond stay in place,” Schultz said.

McCune didn't change the $15,000 bond on the August case, instead he raised the bond on the original cases to $50,000.
